1. Americans have a fundamental right to privacy, but in public places there is no expectation of privacy. A person will always enjoy a reasonable expectation of privacy in his or her home if the police attempt to find him or her. A search can only take place where a person has a reasonable expectation of privacy, such as a person’s home. Privacy is more than personal property for example it can be a phone conversation. Some key differences of privacy and privacy law is that privacy stop the public from accessing personal details whereas privacy laws protects the information from a range of unauthorized people. The Electronic Communications Privacy Act that was established in 1986 control law enforcement at both federal and state level and its important because it protects all wire, oral and electronic communications among private parties. A valid search warrant must be present in order for the government to intercept oral and electronic communications. Privacy laws can be upheld by criminal justice systems by making sure all members are following the rules and upholding the law.

2.Privacy is the confidentiality of one’s personal information, possessions, thoughts, etc. As the saying goes,”the privacy of our own home” which means what goes on in one’s home isn’t the business of anyone outside of that home. Privacy is to be protected by the holder of privacy, but with privacy laws, it is the protection of one’s privacy by law. In the CJS, a person’s privacy should be upheld by the privacy laws such as HIPPA, the Privacy Act, OSHA (in healthcare), etc. and most of all by the personnel working in the system. If a person’s information is being discussed, it should be with their consent and with those that need to know the information in order to complete their duties. As far as improving the expectation of privacy, the criminal justice system should make it a priority to only release necessary information to the public about inmates, ensure only designated personnel has access to their files, and handle the information as if it were their own personal information at stake of being spread.
